You protect your home or business with insurance and work hard
to pay the premium only to have your claim denied. In some situations
you may be a victim of bad faith and fraud.
We have found that some claims are denied for no legitimate reason.
There are cases in which we believe that the insurance adjuster
is told to deny a claim before even inspecting the damage. This
can occur in when a storm causes damage to many houses and buildings.
Many times the insurance company will attempt minimize the extent
of damage and/or attribute the damage to a structural defect and
deny that they are responsible under their contract. Do not give
up. As you can imagine, some companies want you to just give up
and not go to an attorney. If you submit a claim to your insurance
company for payment, and it is denied, you should seek the advice
of an attorney.
Insurance cases are sometimes pursued by way of a class action.
In some situations the settlement may be objectionable and may not
adequately protect the rights of all the members. In these situations,
it may be in the best interest of the class member to opt out of
the class or file an objection. Therefore, if you receive any type
of class action notice, you should seek the advice of an attorney.
The Gartlan Law Firm, LLC represents clients in these types
of cases, and welcome calls of this nature for a free confidential
consultation.
